Grandparent Custody and Visitation / Non-parent Custody


The visitation rights of grandparents is defined in A.R.S. § 25-409, and non-parent, grandparent custody is defined in A.R.S. § 25-415. Grandparent’s rights are not a guarantee and there are very limited circumstances that allow a grandparent to petition the court for visitation. Certain factors must first be met. The court then looks at several factors to determine whether grandparent visitation is in the best interests of the minor child or children.
