BREAKING: ADWR announces Pinal County can’t grow with groundwater

By Rose Law Group Staff Reporter

Minutes ago the Arizona Department of Water Resources announced to a Pinal County water stakeholders group that Pinal County landowners who do not have assured water supply certificates from ADWR can no longer rely on Groundwater to show the water necessary to allow them to develop their property.

ADWR has been working with the Stakeholders group for nearly three years on potential solutions to the water issues relating to Pinal County.  The announcement today was as definitive a statement as the ADWR has made on the subject of future growth in Pinal County.  While thousands of acres of undeveloped land currently have the legal ability to continue to develop, this new approach will limit future development for single family residential homes.

Water Attorney with Rose Law Group (formerly with CAP), David Johnson, attended the meeting and says “ADWR’s position has a number of nuances that need to be further explored but the conclusion – absent a seismic shift in state law, future residential development in Pinal will not occur with groundwater – is something we need to resolve for continued growth.”
